Brothers in Miami agree to permanent ban from tax return preparation

FLORIDA — A U.S. District Court has issued a permanent injunction against two Miami tax preparers, barring them from preparing federal income tax returns after allegations of fraudulent practices.

The injunction, issued by the Southern District of Florida, follows a complaint accusing George Brito and Luis Brito of preparing returns with false deductions and credits.

The complaint alleges that George and Luis Brito, who owned or controlled Brito and Brito Accounting USA Inc., fabricated various deductions and credits for their clients, including false energy credits, exaggerated itemized deductions, and inflated business expenses.

As a result of the permanent injunction, George Brito is prohibited from working in or owning any tax preparation business, assisting others in preparing tax returns or transferring customer lists to any other entity.

His Miami Beach office has been closed as part of the order.

Luis Brito is similarly banned from preparing individual tax returns. Still, he may continue to file specific business-related forms under strict conditions, including random IRS inspections and a requirement to complete at least 24 hours of tax preparation education by the end of the year.

Deputy Assistant Attorney General David A. Hubbert of the Justice Department’s Tax Division made the announcement.
