Fort Myers resident found guilty of distributing deadly para-fluorofentanyl

FLORIDA — A Fort Myers man has been convicted of possession with intent to distribute a controlled substance after a bench trial, where the dangerous synthetic opioid, para-fluorofentanyl, played a role in the charges, according to the U.S. Attorney’s Office for the Middle District of Florida.

Nicholas P. Smith, 45, was found guilty following a bench trial before United States District Judge Sheri Polster Chappell. He faces a maximum penalty of 20 years in federal prison, with his sentencing set for November 18, 2024.

Evidence presented at trial revealed that on September 5, 2023, officers from the Fort Myers Police Department stopped Mr Smith for multiple traffic infractions near Winkler Avenue and Fowler Street in Fort Myers.

During a search, officers reportedly discovered a large plastic bag containing 11 smaller bags of a pink powdery substance. This substance later tested positive for para-fluorofentanyl and fentanyl, both highly potent synthetic opioids.

Para-fluorofentanyl, a particularly dangerous variant of fentanyl, is known for its powerful effects and high risk of overdose, making its distribution especially concerning.

The case was investigated by Homeland Security Investigations and the Fort Myers Police Department, highlighting the ongoing efforts to combat the distribution of synthetic opioids. Assistant United States Attorney Patrick L. Darcey is prosecuting it.
